  1. ELIGIBILITY: NO PURCHASE NECESSARY TO ENTER OR CLAIM PRIZE. MAKING A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. IN ORDER TO ENTER THIS CONTEST, YOU MUST PROVIDE YOUR NAME, PHONE NUMBER AND A VALID EMAIL ADDRESS THROUGH THE LEAD GENERATION CAMPAIGN ON SOCIAL MEDIA OR BISCUITVILLE.COM. THIS IS AN ONLINE ONLY GIVEAWAY. Biscuitville periodically conducts “Breakfast for A Year” promotional giveaways (each a “Giveaway”), and these official terms and conditions (the “Rules”) will apply to all such promotional giveaways unless a different set of rules governs. Subject to these Rules, including the terms and conditions set forth herein, Biscuitville’s “Breakfast for A Year” is open to legal residents of the United States residing in North Carolina, South Carolina, or Virginia who are at least 18 years of age at the time of entry. Officers, directors, employees, and their immediate family members, of Biscuitville, Inc. (“Sponsor”) or of Sponsor’s parent, subsidiary or affiliated companies are ineligible to participate. (Sponsor and its affiliated, parent, and subsidiary companies, and the respective shareholders, directors, officers, employees, members, successors, agents and assigns of the foregoing are referred to collectively herein as the “Released Parties”.) The Giveaway is governed by applicable U.S. and North Carolina law, is subject to these Rules, all applicable federal, state and local laws and regulations, and is void where prohibited. By entering the Giveaway, each entrant represents and warrants to the Sponsor that he or she meets all of the eligibility criteria set forth herein. The Sponsor may reject any Entry at any time if it determines or suspects, in its sole and absolute discretion, that a participant may be ineligible or may otherwise be in violation of applicable law or these Giveaway Rules. A person may win “Breakfast for A Year” only one time. Previous winners of a Biscuitville “Breakfast for A Year” promotion are ineligible to participate in the Giveaway. There will be a total of twenty-five (25) first prize winners (each a “First Prize Winner”) that will be randomly selected and whose prize shall bear an approximate retail value of [insert shirt ARV] and ten (10) grand prize winners (each a “Grand Prize Winner”) that will be randomly selected from the First Prize Winners present at the relevant store’s grand opening and whose prize shall bear a retail value of approximately $10.89 per coupon and $566.28 for the total prize value.
  2. HOW TO ENTER and HOW TO WIN: To enter, you must provide your name, phone number and a valid email address (collectively, “Contact Information”), during the “Entry Period” (as that term is defined below), and via one of the three following entry platforms: (1) Facebook, (2) Instagram, or (3) Biscuitville.com. Additional entry qualifications apply to be eligible to win the Grand Prize, as set forth further below in these Rules.
    By submitting an Entry, you agree to these official Rules. Once submitted, Entries become the sole property of Sponsor and will not be returned. Limit one Entry per person per email address and per Giveaway.  Duplicate Entries, if detected, may be disqualified.  Entries that appear to Sponsor, in its sole discretion, to have been submitted by one entrant using multiple email addresses may be disqualified in Sponsor’s sole discretion.  The Entry Period for the Giveaway applicable to the Opening Day for the Biscuitville restaurant location at 4425 Main Street, Shallotte, NC 28470 Restuarant (the “Opening Day”), begins on February 2nd, 2026 ends at 12:00 AM ET on February 23, 2026. Only First Prize winners are eligible to win the Grand Prize, and only a First Prize winner who attends the Opening Day in person and who is physically present at the time the 10 Grand Prize Winners are announced on Opening Day is eligible to win and collect the Grand Prize.Incomplete Entries are void. Sponsor is not responsible for lost, late, incomplete, illegible, destroyed, misdirected, or invalid Entries, or for technical or administrative issues that interfere with Sponsor’s receipt of an attempted Entry, and all such Entries are void. Mechanically generated Entries are void. Entries generated by any automated means, including but not limited to Entries generated by use of bots, macros, or scripts, are void. An Entry is deemed “received” when it is recorded by Sponsor’s servers. Proof of submission is not and will not be deemed to be proof of receipt by Sponsor.
  3. PRIZES and ODDS OF WINNING: Limit one (1) First Prize and one (1) Grand Prize per person. A total of twenty-five (25) First Prizes and ten (10) Grand Prizes will be offered during this iteration of the Giveaway. Actual number of prizes awarded and collected may vary depending on satisfaction of Entry and eligibility requirements and as otherwise set forth in these Rules. Each First Prize is one Biscuitville t-shirt, valued at approximately $12.99 retail. Each Grand Prize is “Breakfast for A Year”, which is a set of fifty-two (52) voucher coupons, each of which is valid for one free biscuit combo at participating locations. (Coupons not redeemable at Elon University location.) Each coupon is valued at approximately $10.89 retail, for a total approximate retail prize value of $566.28. Actual value of prize may differ, depending on biscuit combo selection when redeeming each coupon. Coupon user will not receive change when using coupon. Each coupon valid for one use only and will not be returned to bearer. Each coupon must be used and redeemed by the date printed on the coupon or, if no date is printed, then within one year of winner’s receipt of prize. Failure to timely use and redeem any coupon results in expiration of the respective coupon and forfeiture of that portion of the prize. All costs, fees, taxes, etc. not specifically described as part of the prize are solely the responsibility of each winner. Prizes cannot be redeemed in whole or in part for cash or substituted by the prize recipient. Sponsor may substitute a prize or component of equal or greater value in its sole discretion. Each winner is solely responsible for all federal, state and local taxes associated with the acceptance of the prize. Unclaimed, forfeited, and rejected prizes will not be awarded. The odds of winning a prize depend on the number of eligible Entries submitted during the corresponding Entry period.
  4.  PRIZE NOTIFICATION and REDEMPTION: Within 48 hours of the end of the Entry Period or as soon as otherwise practicable Sponsor will randomly select 25 First Prize winners from all qualifying Entries. Sponsor will notify those 25 First Prize winners as soon as practicable after their selection and furnish a winner notification form (“Winner Notification”) with additional instructions to collect prize. At Opening Day, 10 Grand Prize Winners will be randomly selected by Sponsor from 25 First Prize Winners. Each First Prize winner must attend the Opening Day in person in order to collect the First Prize and each First Prize winner must be physically present at the time the Grand Prize winners are announced in order to be eligible to win and collect the Grand Prize.
    Except where prohibited, by providing your Contact Information each entrant is releasing Biscuitville from any and all liability regarding the Giveaway, participation in the Giveaway, or use of any prize. Each winner must respond by following the instructions provided in the Winner Notification within seven days or other applicable period to claim prize. Failure to timely respond or follow instructions may result in forfeiture of the prize, in Sponsor’s sole discretion. If a winner has not complied or does not comply with these Rules or is determined by Sponsor to be ineligible, then such person may be disqualified in Sponsor’s sole discretion and Sponsor may, in its sole discretion, select a new winner for that particular iteration of the Giveaway.
    Each winner is subject to verification at the sole discretion of the Sponsor. At Sponsor’s sole discretion, a winner may be required to complete and return Giveaway forms such as releases, IRS W-2, affidavit of eligibility, etc. in order for Sponsor to fulfill prize award. Sponsor shall have the option, in its sole discretion, to require a winner to claim his/her prize in person or to send the respective prize to the winner via postal mail or other delivery agent or service. The Released Parties are not responsible for lost, late, stolen, misdirected, delayed or damaged prizes. The respective intended prize recipient shall bear all risk of loss or damage to his/her prize after it has been directed to such intended recipient via postal mail or other delivery agent or service. Delivery of prize is complete upon Sponsor’s deposit of prize into postal mail or at location for pickup by other delivery agent or service.
  5.  PUBLICITY RELEASE: Except where prohibited, entry in the Giveaway constitutes each entrant’s authorization for and consent to Released Parties and their respective agents and licensees to use, publish, reproduce and for all purposes, including publicity, promotion, merchandising, and advertising, in any media (including without limitation, the Internet, television, radio, or offline, whether now known or developed in the future), each entrant’s name, city, photograph, likeness, biographical material, voice, and image, each in perpetuity without further compensation, credit or right of review or approval. By accepting a prize or participating in prize-related activities, each winner consents to and authorizes Released Parties to use, publish, reproduce and for all purposes, including publicity, promotion, merchandising, and advertising, in any media (including without limitation, the Internet, television, radio, or offline, whether now known or developed in the future), each winner’s name, city, photograph, likeness, biographical material, voice, and image, each in perpetuity without further compensation, credit or right of review or approval.

TERMS AND CONDITIONS; LIMITATION OF LIABILITY: Participants are responsible for complying with all applicable federal, state, and local laws and regulations and with these Rules, and by entering, participants agree to be bound by these Rules. Any attempt by an entrant or other party to tamper with the proper administration of the Giveaway will disqualify the entrant and may result in civil or criminal action against the entrant or other party and may result in the discontinuation, suspension, or cancellation of the Giveaway. In the event the selected prize recipients are/is ineligible or refuse(s) a prize, the prize will be forfeited and Sponsor, in its sole discretion, may, time permitting, select alternate prize recipients from remaining entries, or may elect not to award such prize, where permitted. For prizes valued at $600 or greater, prize recipient must provide his or her Social Security Number for tax purposes. Prizes may be considered income, and any and all taxes associated with prizes are the responsibility of the prize recipients. Sponsor reserves the right to select winners from eligible Entries received as of any such termination date. Sponsor may prohibit an entrant from participating in the Giveaway if it determines that said entrant is attempting to undermine the legitimate operation of the Giveaway by cheating, hacking, deception or other unfair playing practices or intending to abuse, threaten or harass other entrants. John Brittain joined the Biscuitville family in July 2021. As VP of Information Technology, John’s primary responsibility is to establish and maintain healthy relationships with the IT Department’s third-party vendors and to measure their effectiveness in supporting Biscuitville operations. When issues arise, John streamlines solutions and then establishes methods to optimize both the vendor’s and Biscuitville’s performance. Born in Hickory, NC, John graduated from the University of North Carolina at Greensboro with a degree in business administration and marketing. John continued his education with certifications such as Six Sigma Green Belt and Procurement and Contract Management. Today, John lives in Browns Summit, NC, with his wife, Kate, and two daughters. With a passion for keeping active, John enjoys playing in his sand volleyball league and is an avid basketball fan.

KATHIE NIVEN​

President, Chief Executive Officer​

Kathie Niven joined Biscuitville in 2011 and led the brand’s transformation to its FRESH SOUTHERN® identity. She became President in 2018 and CEO in 2021, guiding the company’s growth to more than 85 restaurants across the Carolinas and Virginia while strengthening its people-first culture. Under her leadership, Biscuitville has earned national recognition, including being named USA Today Readers’ Choice Best Fast Food Breakfast in 2023, 2024 and 2025. Niven previously held executive roles with Quiznos, Arby’s, Burger King and Krispy Kreme. A graduate of Elon University, she also completed advanced leadership training through the Center for Creative Leadership, UNC Kenan-Flagler and Harvard University. She lives in Greensboro, North Carolina, with her husband, Drew, and their two children.

KEVIN BENNETT​

Chief Financial Officer

As Chief Financial Officer, Kevin supports Biscuitville’s strategic growth initiatives and manages the company’s financial plans. He and his teams provide financial and operational insights into the business, as well as accounting, finance, IT, risk, and compensation-support services. Prior to Biscuitville, Kevin gained years of financial leadership and multi-unit retail experience as Director of Finance with Circle K Stores and Assistant Controller with The Pantry, operating as Kangaroo Express. He began his professional career as an auditor after earning his BS in accountancy at Villanova University in 2003. Kevin earned his MBA at Duke University’s Fuqua School of Business in 2016, and he’s a Certified Public Account, licensed in North Carolina. Kevin and his wife, Megan, enjoy time with their kids, Molly, Ryan, and Lila.

BELINDA KYLE

Chief People Officer

Belinda Kyle joined Biscuitville in 2022 as Chief People Officer, bringing more than 30 years of hospitality operations and human resources experience. Her career includes leadership roles with Treasure Island Resort & Casino, Romano’s Macaroni Grill and Dinosaur Bar-B-Que. Kyle holds a degree in human resource management from the University of Phoenix and is a SHRM Senior Certified Professional. Active in her community, she volunteers with the American Cancer Society and lives in Lexington, North Carolina..

BLAKE JENNINGS​

Chief Development Officer

Blake Jennings became Biscuitville’s Chief Development Officer in 2023 and oversees real estate development, construction, facilities and IT. Since joining the company in 2018, he has played a key role in building the development pipeline supporting Biscuitville’s accelerated growth. Jennings previously worked in mixed-use and multifamily development with Kane Realty Corporation and held finance and asset management roles at First Potomac Realty Trust. He earned a finance degree from Wake Forest University’s School of Business and lives in Greensboro, North Carolina, with his wife, Melanie, and their three children.

JIM MCCURLEY

Chief Restaurant Excellence Officer

Professional Background
Jim McCurley was named Chief Restaurant Excellence Officer in 2023. He has been a member of the Biscuitville Fresh Southern® family since August 2019, when he joined the organization as the Vice President of Culinary Operations.

McCurley’s experience includes work as an Executive Sous Chef during his school years, serving as a Regional Executive Chef in Washington, D.C., and then joining P.F. Chang’s for the next 17 years, helping them transform from a start-up to over 225 locations nationwide. Before joining Biscuitville, McCurley was Senior Director of Operations for Tupelo Honey Café, based in Asheville, North Carolina.

Education
Born and raised in Providence, Rhode Island, McCurley attended Johnson & Wales at their Providence campus, earning his Bachelor of Science in restaurant/food services management and his MBA in international business. In addition to his formal education, McCurley is a Lean Six Sigma Certified Black Belt, Certified Lean Practitioner, Agile Certified and a Certified Scrum Master.

Community and Family
Today McCurley lives in the Greensboro area and enjoys spending time with family and friends.

KRISTIE MITCHELL

Chief Marketing Officer

Professional Background
Kristie Mitchell was promoted to Greensboro-based Biscuitville’s Chief Marketing Officer in December 2023. Prior to her promotion, she served since 2018 as Vice President of Brand and Marketing. A member of the company’s Leadership Team, she heads the work groups that generate media, advertising, point of purchase materials, public relations, social media, website, consumer analytics and all aspects of design.

When she joined Biscuitville in 2015, Mitchell was asked to co-lead the company’s comprehensive rebranding of all restaurant remodels, rebuilds and new locations. Today, all the properties across the multi-state enterprise feature the rebranded design features. Mitchell was closely involved with the brand design of the new 70,000-square-foot distribution center in Burlington, which opened in 2022.

As a member of the product innovation leadership team, Mitchell partners closely with Culinary Operations to determine featured menu items and how they will be promoted to drive incremental lift through paid and organic media along with on-premises. She led the initiative to create the “Life After 2®” campaign, focused on employee satisfaction and recruitment, and the trademarked external initiatives like “The Flavor of Local®”, “Farm to Drive-Thru®” and “Home of the Biscuit Window®.”

LARRY WILLIAMS​

Chief Supply Chain Officer​

Professional Background
Larry Williams joined Biscuitville Fresh Southern® in May of 1989. As Chief Supply Chain Officer, Williams is responsible for Biscuitville’s Internal Distribution System, overseeing Distribution Center Operations, Warehouse Management System technology, Procurement and Transportation.

Community and Family
Williams and his wife, Diana, have two children and five grandchildren. Together they enjoy traveling and spoiling their grandkids.

KIM AVERY

Vice President of Operations​

Professional Background
Kim Avery was promoted to Vice President of Operations in February 2024. She now leads Biscuitville’s field operations with oversight of all restaurants in North Carolina, South Carolina and Virginia. She reports to President and CEO, Kathie Niven. Avery joined Biscuitville in 2020 as an Area Director, and since then has stepped into positions with increasing responsibility. She was named Region Director in March 2022 and became Region Vice President in December 2022.

Community and Family
Avery was born and raised in Florida and moved to North Carolina in March 2020 to join the Biscuitville team. She currently resides in Stoneville, North Carolina, with her three cats. In her spare time, Avery is an award-winning mixed-media artist who donates her art to auctions supporting her favorite causes.

Executive Chair

In 1996, Burney took over the reins of the family business from his father, Maurice, as President and CEO. Today he continues to serve as Executive Chair of Biscuitville Fresh Southern®, a company that’s grown under his leadership into an $80 million business with over 70 locations (and counting). A graduate of Elon University, Burney serves on its Board of Trustees and has received its “Young Alumnus of the Year” award, as well as its “Legends of Business” award. He’s also active with the Greensboro Rotary, Greensboro Sports Council, and Greensboro Partnership. Triad Business Journal named Burney one of its “2016 Most Admired CEOs in the Triad.” He and his wife Dina, also an Elon grad, have four children: Blake, Bailey, Mary Frances, and John. In his free time, Burney likes spending time with his family in the mountains of North Carolina and also enjoys running, hiking, and golf.
